STIHL Timbersports Experience

Terms & Conditions:

Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion deems acceptance of these conditions of entry.

1. Entry is open to all Australian residents who purchase any STIHL product at a participating STIHL Dealer during the promotional period. Employees of the Promoter, its related companies, their agencies or members of their immediate families are ineligible.

2. The promotion commences 1st April, 2015 and closes 23.59 AEST on 31st May, 2015.

3. To be eligible, customers must a. purchase any STIHL Power Tool during the promotion period, b. enter online during the promotional period at www.stihl.com.au/timbersportsexperience and complete the entry form by entering their details, answering the associated questions and tell us in 50 words or less why you deserve to win the STIHL Timbersports Experience, c. winners will be required to provide proof of purchase to be eligible.

4. Only one entry is permitted per transaction.

5. The winner will be determined by a judging panel by the June 15, 2015. Chance takes no part in determining winners. Winners will be judged on merit and originality.

6. The prize winner and 3 of their mates will attend “A STIHL Timbersports Experience ” which will include return airfares (from nearest capital city) where applicable to the next STIHL Timbersports event in Australia, transfers to and from the event, accommodation and airport. 1 Night’s accommodation and meals. Winners will be trained by Australia’s best trainers on how to use a Single Buck Saw. Then complete against each other in front of a crowd at an official STIHL Timbersports Australian Championship event. Total prize pool is up to $10,000. Any additional expenses incurred by the winner in relation to goods and services that are not expressly specified as part of the prize (above) will be payable by the winner and any terms and conditions of the provider of the goods or services will apply.

7. Winners will be notified by telephone and in writing by June 15, 2015. The winners name will be published on the stihl.com.au website and STIHL Australia Facebook page on June 22, 2015.

8. The Promoter accepts no responsibility for any variation in the prize values. Prizes including any unused portion are not transferable or exchangeable and cannot be taken as cash.

9. It is the responsibility of the winner to be available to take the prize on the dates that the Timbersports event is offered. In the event that for any reason whatsoever the prize winner does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu of that element of the prize.

10. Prizes are subject to the terms and conditions of participating service providers. Including but not limited to the following: The participant must be over 18 years of age. Clothing should include long sleeved shirt, trousers and fully covered footwear such as trainers or ankle boots. No sandals or high heeled shoes. All participants will be required to sign a legally binding Release, Waiver, and Discharge.

11. The Promoter accepts no responsibility for any loss incurred in the event that the Timbersports event is cancelled for any reason beyond the control of the Promoter. The participant agrees to comply with the behaviors outlined below: (a) I agree to act in a sports like manner. I will not engage in behavior likely to confer upon myself an unfair competitive advantage nor likely to unfairly disadvantage another competitor. (b) I will comply with the anti-doping rules of the World Anti-Doping Agency, which can be viewed in English at www.wada-ama.org, or in German at www.nada-bonn.de. I will comply with the Event rules that are communicated to me before and at the Events. (c) I agree to treat other competitors, officials, volunteers and spectators with respect and courtesy and avoid the use of abusive or offensive language. (d) I agree to follow all instructions given by or on behalf of STIHL immediately and unconditionally, in order to be able to ensure the safety of STIHL’s representatives, the other participants, and the spectators. (e) I agree to refrain from making negative public statements about STIHL and/or other Event sponsors or their respective products (f) In circumstances where STIHL receives information giving it reasonable grounds for suspecting I am in breach of this Agreement before or during an Event or will breach this Agreement in the course of an Event, STIHL may in its sole discretion exclude me from further participation in the Event (g) In the event of breach of this Agreement (including infraction of the anti-doping rules of the World Anti-Doping Agency), STIHL will be entitled to disqualify me from participation in the Events effective immediately, to strip me of existing placings and titles (where appropriate) and/or to bar me from events in the following season. In the event of a repeated doping offence, STIHL reserves the right to exclude me for life from STIHL® TIMBERSPORTS® events.

12. The Promoter and its associated agencies and companies, shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a consequence of the use and enjoyment of the prize, except for any liability which cannot be excluded by law (in which case liability will be limited to the minimum allowable by law).

13. The winners acknowledge and accept that timber cutting and related activities are dangerous and accidents can happen, and that participation in any prize has a degree of danger. To the extent permitted by law, the winners will exclude, release and forever discharge the Promoter and all other persons involved in the conduct promotion and organisation of any component of the prize, and their respective employees, agents, sub-contractors, consultants (including employees of those sub-contractors and consultants) directors, officers and sublicensees from all liability for claims, loss, damage, costs or expenses (whether arising under stature, from negligence, personal injury, death, property damage infringement of third party rights or otherwise) arising from or in connection with the participation of the prize.

14. The Promoter reserves the right, in its sole discretion, to disqualify any individual for: tampering with the entry process, acting in violation of these terms and conditions; acting in an unsportsmanlike or disruptive manner; or acting with the intent to annoy, abuse, threaten or harass any other person.

15. Promoter reserves the right to conduct security validation check at its absolute discretion. Prize winners may be required to sign a declaration confirming their eligibility to accept and participate in the prize.

16. The promoter reserves the right to contact an entrant at any time after receiving an entry, during or after the promotional period or after the prize is determined for the purpose of determining whether the entrant meets the eligibility requirements.

17. The promoter’s decision is final and binding and no correspondence will be entered into. No responsibility is taken for misdirected entries.

18. The Promoter collects entrants’ personal information in order to conduct the promotion. If the personal information requested is not provided, the entrant may not participate in the promotion. The information participants provide will be used by the Promoter for the purpose of conducting this promotion. The promoter may disclose entrant’s personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legistration. The Promoter is bound by the relevant privacy legislation. Entrants can request access to, update or correct the information the Promoter holds about them or obtain a copy of the Promoter’s privacy policy by contacting the Promoter on www.stihl.com.au. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may include the entrant’s name and address in a database, disclose it to the Promoter’s business partners and use it for future telephone, mail or electronic message promotional campaigns and communications by the promoter and its business partners without any further reference payment or other compensation to the entrant.

19. In the event of war terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
