STIHL Free Gear- FS Protect Hi-Vis Trousers - Terms & Conditions

Terms & Conditions:

1. Information on how to participate in the STIHL Free Gear Offer forms part of these Terms and Conditions. Claims that do not comply with these Conditions of Entry are ineligible. Internet access and a valid email account are required to redeem the STIHL Free Gear. By redeeming the STIHL Free Gear, Participants agree to be bound by these Terms and Conditions. “STIHL Free Gear” is defined to include STIHL branded clothing and accessories relevant to this promotion as detailed in clause 4.

2. The Promoter and STIHL dealers, their respective employees, immediate families, affiliated companies, agencies and any connected insurance recovery organisation are ineligible to claim on the STIHL Free Gear promotion. Government Departments and Councils are eligible to participate through their associated dealership. The STIHL Free Gear Promotion is only open to Participants. “Participants” means residents of Australia (other than the excluded persons set out in this clause 2) who purchase a qualifying Product from a participating STIHL dealer during the promotional period. “Product” refers to any STIHL product model mentioned within clause 4.

3. The Promoter is STIHL Pty. Ltd. A.B.N. 76 004 881 145 of 5 Kingston Park Court, Knoxfield, Victoria, Australia. 3180. Any queries relating to submitting claims should be made in writing via email to promotions@stihl.com.au.

4. To obtain the STIHL Free Gear giveaways, Participants must purchase during the promotional period (as set out in clause 5) one of the following STIHL products to qualify to receive the accompanying free gear giveaway: FS 130 Brushcutter for FS Protective Work Trousers Hi-Vis, FS 250 R Brushcutter for FS Protective Work Trousers Hi-Vis, FS 250 Brushcutter for FS Protective Work Trousers Hi-Vis, FS 260 C-E Brushcutter FS Protective Work Trousers Hi-Vis, FS 360 C-E for FS Protective Work Trousers Hi-Vis, FS 460 C-EM for FS Protective Work Trousers Hi-Vis and FS 560 C-EM for FS Protective Work Trousers Hi-Vis. The Promotion is available whilst stocks last on product and sizes within the period specified in clause 5 below and no rain checks are accepted.

5. Entries into the promotion are valid only for Products purchased and paid for in full in Australia from authorized and participating STIHL dealers between: January 1st, 2016 to March 31st, 2016 (inclusive). Final claims must be lodged by 11:59pm on 15th April, 2016. Participant(s) will forfeit offer claims not made by this date.

6. To lodge a Free Gear claim the Participant must visit www.stihl.com.au/freegear and complete an official online claim form by entering their details, selecting the desired sizing from the sizing chart, answering the associated questions, nominate a preferred STIHL dealer (set out in clause 8) entering the unique serial number from their purchased Product and the unique code from the offer claim form issued at the place of Product purchase. Size selections are final and cannot be changed once an offer claim has been lodged. No returns are accepted. Offer claims must be only submitted via the internet at www.stihl.com.au/freegear. Any offer claim forms sent via post, facsimile or any other method will not be accepted.

7. Multiple offer claims are accepted. Each claim must include serial number and unique code for each separate item purchased. Each Product purchased can only be used once for redeeming the offer. Claims will be deemed invalid if the same serial number and / or unique code is used on more than one claim. STIHL reserve the right to request that claimants present proof of purchase for offer claim validation.

8. Upon completing an offer claim, the Participant will be issued with a confirmation of order email and associated reference number. Participant must nominate preferred dealer they wish the order be delivered to no orders can be sent to a Participants private or business address other than that of a registered STIHL dealership. Participants will be advised via email and or by the participating STIHL dealer by the distributor when they can pick up their order.

9. Please allow approximately 60 days from the date that the offer claim is validated for processing.

10. Participants must pick up their goods from their nominated dealer within 30 days of receiving the original email that their order is ready to be picked up.

11. Once issued, offer claims will not be reissued for any reason.

12. If a Participant claims the Free Gear, and later returns or exchanges the Product in accordance with law or the relevant STIHL dealer’s terms and conditions of sale, then the amount refunded or credited to the Participant will be the amount paid for the Product, less the offer claim amount.

13. The Promoter reserves the right to extend the closing date of the promotion at its discretion.

14. With the exception of ordinary Product discounts in the form of in store sales offered by STIHL dealers, the promotion is not valid in conjunction with any other promotional offer.

15. The Promoter’s decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into.

16. Claims are not transferable or assignable.

17. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for a personal injury suffered or sustained, as a result of participation in this promotion, except for any liability which cannot be excluded by law.

18. The Promoter will use the information contained in the claim form to contact Participants if it has any queries regarding offer claims, and to complete offer claims.

19. The Promoter reserves the right to verify all entries. Entries are void if illegible, forged or tampered with in any way. No responsibility is accepted for late, lost or misdirected offer claims via the internet.

20. The Promoter reserves the right in its sole discretion to disqualify any claimant who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the promotion. The Promoter reserves its rights to recover damages or other compensation from such an offender.

21. To the extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any web site, or any unauthorised intervention, or any combination thereof, including problems that prevents a Participant from obtaining Free Gear, or which cause injury or damage to the Participant’s or any other person’s computer related to or resulting from participation or attempted participation in this promotion.

22. If for any reason the Free Gear is not capable of running as planned including; infection by computer virus, bugs, tampering, requirement of a regulatory body, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration security, fairness integrity or proper conduct of this redemption, the Promoter reserves the right in its sole discretion, to cancel, terminate, modify or suspend this promotion.

23. The Promoter collects personal information about Participants for the purpose of including Participants in the promotion. Unless otherwise notified by the Participant to the Promoter in writing, in providing their personal details, each Participant agrees to the Promoter using their details for future marketing and publicity purposes, to the extent permitted by the law, and to the Promoter disclosing such information to third parties for this purpose. If any information requested is not provided, the purchaser may not participate in this promotion. All personal details of Participants will be stored in a database at the office of the Promoter or its Agencies. The Promoter is committed to the protection of personal information. A request to access, update or correct any information should be directed to the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information may be obtained on – line at www.stihl.com.au.
